The Zoning Board of Appeals (ZBA) consists of 5 Township residents appointed by the Commerce Township Board of Trustees, which includes one elected official and one appointed member from the Planning Commission. The Zoning Board of Appeals visits each property prior to the public hearing for that application. The ZBA opens the public hearing and listens to any comments as well as the petitioner’s presentation. The Township Planner visits each property also and provides a Finding of Fact report to the ZBA for their review. This report is also sent to each petitioner along with a copy of the agenda for that night.
The Zoning Board of Appeals shall perform its duties and exercise its powers as provided in Michigan Act 110 of the Public Acts of 2006, as amended, and in such a way that the objectives of this Ordinance shall be observed, the public safety and welfare secured, and substantial justice done. The Zoning Board of Appeals meets to hear the following requests:
- Variance
- Ordinance or Map Interpretation
- Appeal from an administrative decision
- Sign Exception
The fee for applying for a Zoning Board of Appeals request is $350.00 which is non-refundable.
