Ordinance Enforcement Process
When a potential ordinance violation is reported or identified, the Ordinance Department follows the process outlined below to work toward compliance.
1. Case Initiation
An ordinance enforcement case is opened and assigned to an Ordinance Officer.
2. Initial Inspection
The assigned Ordinance Officer will visit the property to determine the nature and validity of the reported violation.
- The officer must be able to observe the violation from a public street, sidewalk, or driveway.
- In certain situations, written or verbal consent may be required to enter private property to verify the violation.
- If a violation is confirmed, a Notice of Violation letter describing the issue will be mailed to the responsible party.
3. Compliance Re-Check
A compliance re-inspection is generally scheduled following the initial inspection. The timeframe depends on the type and severity of the violation.
4. Enforcement Action
If the violation is not corrected by the compliance deadline, further enforcement action may be taken, which may include:
- Issuance of a citation or a Final Notice of Violation letter, depending on the circumstances.
Extensions may be granted when documented progress toward compliance is demonstrated.
5. Court Proceedings
If a citation is issued, the responsible person(s) will be required to appear before the 52-1 District Court.
Our Commitment: The Ordinance Department’s goal is to achieve compliance through cooperation and communication with property owners. Citations are always a last resort and are issued only when voluntary compliance efforts have been unsuccessful.
